Buea Mayor, Others Restrained From Transgression

The Buea High Court, November 8, 2016, handed down a ruling against the Mayor of Buea, Patrick Esunge Ekema, and others, over transgression of a private estate in Molyko Buea.

The applicant in the matter is Dr. Fongoum Christopher Giddo, and the six respondents are (1) Christiana Koloko, (2) Ekema Patrick Esunge (3) Chief of Centre for Surveys, Buea (4) Ministry of Urban Development and Housing (5) Ministry of State Property and Land Tenure (6) Ministry of Public Health.

Dr. Fongoum Giddo had, through his Counsel, Barrister Nicholas Egbe, prayed the court to pass; “An order of interim injunction restraining the 1st and 2nd Respondents, their assigns, agents, privies or howsoever called from going into or carrying out any development activities whatsoever on the land lying and situate at Malingo Street, Molyko-Buea pending the determination of the motion on notice for an interlocutory injunction…”

After examining the matter and visiting the locus in quo, the court, presided at by Magistrate Eseme Otto Ngame, with Leonard Teke as Registrar-in-Chief, ruled on November 8: (1) “That applicants prayer is hereby granted; (2) “That an order of interim injunction is hereby made restraining the 1st and 2nd respondents, their servants, agents, privies or howsoever called from going into or carrying out developmental activities whatsoever on the land lying and situate at malingo Street, Molyko-Buea pending the determination of the motion on notice for interlocutory injunction.
